TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of https://maisontropea.com (the “Site”) and purchases from Tropea (“Tropea,” “we,” “us,” or “our”). By visiting the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Return and Refund Policy.

1. ELIGIBILITY AND ACCEPTABLE USE

You must be able to enter into a legally binding agreement in your jurisdiction to use the Site or purchase products. You may not use the Site for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with Site security; introduce malicious code; scrape or access the Site through unauthorized automated means; or violate the rights of Tropea or any third party.

2. PRODUCT INFORMATION

We make reasonable efforts to present product descriptions, photographs, dimensions, materials, colors, availability, and pricing accurately. Screen settings and lighting may affect how colors appear. Minor differences that do not materially affect a product’s function may occur. Product availability may change without notice.

Any wellness, beauty, lifestyle, or performance-related information is provided for general informational purposes only and is not medical advice. We do not make claims that a product diagnoses, treats, cures, or prevents disease unless expressly authorized by applicable law and supported by appropriate evidence.

3. PRICES, TAXES, AND PAYMENT

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, discounts, and the final order total are displayed before you submit payment. We do not add undisclosed charges after checkout.

Payments are processed by authorized third-party payment providers, including providers made available through Shopify. You represent that you are authorized to use the selected payment method. We may correct obvious pricing or description errors before accepting an order. If payment was already captured for an order we cannot fulfill, we will issue a refund to the original payment method.

4. ORDERS

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may accept, decline, limit, or cancel an order for legitimate reasons, including payment authorization failure, suspected fraud, inventory errors, inaccurate customer information, shipping restrictions, legal requirements, or an obvious pricing error.

If we cancel after charging you, we will refund the affected amount to the original payment method. We may limit quantities per person, household, address, or order when reasonably necessary to prevent fraud or resale abuse.

5. SHIPPING AND DELIVERY

We currently sell and ship to eligible addresses in the United States. Processing times, delivery estimates, shipping charges, carriers, tracking, address changes, delayed orders, and lost or damaged shipments are governed by our Shipping Policy.

Delivery dates are estimates rather than guarantees. If we cannot ship within the stated time or, when no time is stated, within the period required by U.S. law, we will notify you and provide the choices required by the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule, including consent to a revised date or cancellation and prompt refund where applicable.

6. RETURNS AND REFUNDS

Returns, exchanges, damaged or incorrect items, non-returnable products, return shipping, and refunds are governed by our Return and Refund Policy. Eligible return requests must be submitted within 30 days after delivery. Approved refunds are sent to the original payment method, subject to financial-institution processing times.

7. PROMOTIONS AND DISCOUNTS

Promotions, coupon codes, gifts, bundles, and limited-time offers are subject to the conditions disclosed with the offer. Unless stated otherwise, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively. We will clearly disclose material conditions, eligibility, duration, and limitations.

8. ACCOUNTS AND COMMUNICATIONS

You are responsible for keeping account credentials confidential and for information submitted through your account. Notify us promptly of suspected unauthorized access. You agree that we may send transactional communications relating to orders, payments, shipping, returns, security, or customer service. Marketing communications are sent only as permitted by law, and you may unsubscribe through the link provided.

9. REVIEWS AND USER CONTENT

If you submit a review, photograph, comment, or other content, you confirm that it is truthful, based on your genuine experience, lawful, and does not infringe another person’s rights. You grant Tropea a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business and marketing, subject to applicable law. We may moderate or remove content that is unlawful, deceptive, abusive, irrelevant, or violates these Terms. We do not condition incentives on positive reviews and will disclose material incentives where required.

10. INTELLECTUAL PROPERTY

The Site and its original content, design, text, graphics, logos, photographs, and software are owned by or licensed to Tropea and protected by applicable intellectual-property laws. You may use the Site only for personal, non-commercial shopping purposes. No license is granted except the limited right to use the Site under these Terms.

11. THIRD-PARTY SERVICES AND LINKS

The Site may rely on or link to third-party services, including Shopify, payment processors, shipping providers, social networks, analytics services, and advertising platforms. Third-party services are governed by their own terms and policies. We are not responsible for independent third-party websites, but this clause does not limit responsibility that cannot lawfully be excluded.

12. PRIVACY

Our Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected, including the use of cookies, analytics, and advertising technologies and privacy choices available to eligible U.S. residents.

13. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the Site and products are provided on an “as available” basis, and we disclaim implied warranties not expressly provided, including merchantability, fitness for a particular purpose, and non-infringement. This disclaimer does not exclude warranties, remedies, or consumer rights that cannot lawfully be limited.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Tropea will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or products. Where liability cannot be excluded, our aggregate liability for a claim will not exceed the amount you paid for the product or order giving rise to the claim. Nothing in these Terms excludes liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability that cannot legally be excluded.

15. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Tropea against third-party claims arising from your unlawful misuse of the Site, violation of these Terms, or infringement of another person’s rights. This obligation does not apply to claims caused by Tropea’s own unlawful conduct.

16. GOVERNING LAW

These Terms are governed by the laws of the State of New Mexico and applicable federal laws of the United States, without regard to conflict-of-law principles. Mandatory consumer protections and rights available in your state of residence remain unaffected.

17. CHANGES TO THESE TERMS

We may update these Terms to reflect legal, operational, or service changes. The revised Terms will be posted with a new “Last updated” date. Material changes apply prospectively unless applicable law permits otherwise.

18. SEVERABILITY AND ENTIRE AGREEMENT

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms and the policies incorporated by reference constitute the agreement between you and Tropea concerning the Site and purchases, except for any additional terms expressly disclosed and accepted at checkout.
